Terms & Conditions

These Terms & Conditions (the “Terms”) govern your access to and use of the Rentify mobile application and related services (collectively, the “Service”). By downloading or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

1. Definitions

  1. “Rentify,” “we,” “us,” or “our” refers to Rentify, its subsidiaries, affiliates, and/or any entity that operates the Service on its behalf.
  2. “User,” “you,” or “your” refers to any individual or entity that creates an account or uses the Service in any way.
  3. “RNPL” or “Rent Now, Pay Later” refers to the financing option through which Users may rent items by making payments over time.
  4. “Rewards Program” refers to any loyalty or incentive program run by Rentify that offers rewards, points, credits, or other benefits to Users.

2. Eligibility and Account Registration

  1. Age Requirement: You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account and use the Service.
  2. Account Information: You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  3. Updates: You agree to promptly update your account information (including contact information) to keep it accurate and current.

3. Scope of the Service

  1. Renting Items: Rentify facilitates the renting of various items or services (“Products”) from third-party owners or directly from Rentify (depending on the model).
  2. No Guarantees: While we aim to provide a reliable platform, we do not guarantee the availability, condition, or suitability of any Product for any particular purpose.
  3. Third-Party Providers: Some aspects of the Service may be provided by third parties. Your use of those services is governed by separate agreements with those third parties in addition to these Terms.

4. RNPL (Rent Now, Pay Later) Program

  1. Program Overview: The RNPL program allows eligible Users to rent items and defer payments according to a set schedule.
  2. Eligibility Criteria:
    • You must undergo a credit assessment or other eligibility checks as determined by Rentify or its financing partners.
    • Approval is at the sole discretion of Rentify or its financing partners.
  3. Repayment Terms:
    • You agree to repay the total rental amount plus any applicable fees, late fees or charges according to the payment schedule outlined at checkout.
    • Late payments may result in additional fees or penalties, and failure to make payments may affect your credit rating (where applicable).
  4. Collection and Default:
    • If you fail to make payments, Rentify or its financing partners may initiate collection procedures.
    • Rentify reserves the right to terminate your access to the RNPL program if you fail to meet your payment obligations.
  5. Disputes:
    • Any dispute related to RNPL payments must be raised promptly. Rentify may temporarily suspend or adjust billing while investigating a dispute at our sole discretion.

5. Rewards Program

Program Participation (Hiba Nature of Rewards): Participation in the Rewards Program is optional and subject to these Terms. Any rewards, points, credits, discounts, or similar benefits granted under this program are provided by Rentify on a voluntary basis as a Hiba (gift). Rewards are granted at Rentify’s sole discretion and do not form part of any rental contract, financing arrangement, or payment obligation. Participation in the program does not create any contractual entitlement to rewards.
  1. Earning Rewards:
    • Rewards (points, credits, discounts, etc.) may be earned through qualifying actions (e.g., successful rentals, referrals, promotional offers).
    • Reward accumulation rates and qualifying actions can be changed by Rentify at any time.
  2. Redeeming Rewards:
    • Rewards can be redeemed on the Service according to the redemption rules posted within the app.
    • Rewards have no cash value unless otherwise specified, and may not be exchanged for cash.
  3. Expiration and Changes:
    • Rentify may impose expiration dates on Rewards or modify the program rules at any time.
    • If the Rewards Program is discontinued, all unredeemed rewards may expire without compensation.
  4. Abuse and Termination:
    • Any fraud, abuse, or violation of the program rules may result in suspension or termination of your participation and forfeiture of accumulated rewards.

6. User Responsibilities

  1. Compliance with Laws: You agree to use the Service in compliance with all applicable local, state, national, and international laws and regulations.
  2. Prohibited Activities: You must not:
    • Use the Service for any unlawful purpose or in a manner that could damage, disable, or impair our servers or networks.
    • Engage in any fraudulent, misleading, or deceptive conduct, including misrepresenting your identity, credit information, or other details.
    • Attempt to gain unauthorized access to any portion of the Service or related systems.
  3. Product Use:
    • You are responsible for using rented items in accordance with their intended use and any instructions provided.
    • You shall not modify, damage, or misuse rented items.

7. Payment, Fees, and Taxes

  1. Payment Method: You must maintain at least one valid payment method in your account. By submitting payment details, you represent and warrant that you are authorized to use the designated payment method.
  2. Billing: If you incur any fees (rental fees, RNPL charges, etc.), Rentify or its payment processor may automatically charge the payment method you have on file.
  3. Taxes: You are responsible for any applicable taxes, levies, or duties imposed by taxing authorities related to your use of the Service.

8. Intellectual Property

  1. Rentify Materials: All content, trademarks, logos, and intellectual property provided on or through the Service are owned or licensed by Rentify. You may not use any content for commercial purposes without express written permission.
  2. User Content: Any content you submit (e.g., reviews or feedback) remains your property. However, you grant Rentify a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with the Service.

9. Disclaimer of Warranties

  1. “As Is” Basis: The Service, including RNPL and Rewards Program features, is provided on an “as is” and “as available” basis. Rentify makes no warranties or representations of any kind, whether express or implied, regarding the Service, including fitness for a particular purpose, accuracy, or availability.
  2. No Guarantee: Rentify does not guarantee that the Service will meet your requirements, be uninterrupted, error-free, secure, or free of viruses or other harmful components.

10. Limitation of Liability

  1. No Indirect Damages: To the maximum extent permitted by law, Rentify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
  2. Aggregate Liability: In no event shall Rentify’s total liability to you for all claims exceed the amount paid by you, if any, for accessing or using the Service in the six (6) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Rentify, its affiliates, officers, directors, employees, and agents, from any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:
  1. Your breach of these Terms;
  2. Your violation of any law or rights of a third party; or
  3. Your use or misuse of the Service.

12. Termination

  1. Termination by You: You may discontinue using the Service and close your account at any time.
  2. Termination by Rentify: We may suspend or terminate your account or access to the Service at any time, with or without notice, for any reason, including violation of these Terms or applicable law.
  3. Effect of Termination: Upon termination, your right to use the Service immediately ceases. Any outstanding obligations under these Terms will survive.

13. Changes to These Terms

We may update or modify these Terms at any time by posting the revised version on our website or within the app. The updated Terms will be effective immediately upon posting. Your continued use of the Service after any changes indicates your acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

  1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of [UAE], without regard to its conflict of law principles.
  2. Dispute Resolution:
    • In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, the parties agree to first attempt to resolve the matter amicably.
    • If unresolved, disputes shall be resolved in [UAE], pursuant to the rules of [UAE].

15. General Provisions

  1. Entire Agreement: These Terms, along with any additional policies or agreements referenced herein, constitute the entire agreement between you and Rentify regarding your use of the Service.
  2. Severability: If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and all other provisions will remain in full force.
  3. No Waiver: The failure of Rentify to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  4. Assignment: You may not assign or transfer your rights or obligations under these Terms without Rentify’s prior written consent. We may assign our rights and obligations at any time without notice.
